Return and Refund Policy
1. Defects of Conformity
At the time of delivery, the Products must be checked by the Customer to ensure that they match the ordered items and do not present manufacturing defects or conformity issues.
The legal guarantees provided by the applicable laws apply to the sale of Products, as well as any additional warranties that may be provided to the Customer.
In the event of manufacturing defects or conformity issues, the Customer has the right to have the Product's conformity restored, free of charge, through repair or replacement, unless the requested remedy is objectively impossible or excessively burdensome compared to the alternative. If one of the cases provided by law occurs, the Customer may request an appropriate price reduction or the termination of the contract with the consequent refund of the price paid.
It is understood that the Customer forfeits this right if they do not report the conformity defect to Pop Corn Milano within 2 (two) months from the date the defect was discovered. In any case, Pop Corn Milano is liable only for conformity defects that appear within 2 (two) years of the Product’s delivery. The action to enforce defects is time-barred after 26 (twenty-six) months from the date of Product delivery.
To report the presence of defects or non-conformities in the Products and obtain one of the remedies listed above, the Customer may contact Pop Corn Milano at the email address magazzino@popcornmilano.com and provide the following information: Name, Surname, order number, address and collection time, telephone number, and attach photographs of the defects.
2. Right of Withdrawal
The Customer has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery or collection of the Products, except in the case of Customized Products.
To exercise the right of withdrawal, the Customer must send an email to magazzino@popcornmilano.com within 14 (fourteen) days of receiving the order, stating their withdrawal request in accordance with Article 52 of Legislative Decree 206/2005. The following information must be included: Name, Surname, order number, reason for return, telephone number, and bank account details for the refund. Pop Corn Milano will reply with instructions on how to proceed with the return, including the shipping address.
The Product may be returned using a label provided by Pop Corn Milano, or the Customer may arrange the shipment with a courier of their choice. If the Customer wishes to use the label provided by Pop Corn Milano, they must request it by writing to magazzino@popcornmilano.com. In this case, the shipping costs will be deducted from the refund. Any customs duties on returns, if applicable, will be covered by Pop Corn Milano.
The return shipping costs and any responsibility for loss, theft, damage, or delays in delivery are the Customer's responsibility.
The Customer agrees to return the Products for which they exercised the right of withdrawal without undue delay and, in any case, within 14 (fourteen) days from the date they communicated their decision to withdraw from the contract to Pop Corn Milano.
The Products must be returned in the same condition in which they were delivered. The Customer must therefore ensure that the Products are intact, complete, unused, unworn, and undamaged, and that they are returned in their original packaging with all attached labels. Pop Corn Milano will verify the packaging and condition of each returned Product, as the substantial integrity of the Products is an essential requirement for exercising the right of withdrawal.
Pop Corn Milano reserves the right to refuse the return of Products that are found to be damaged, deteriorated, dirty, or in a condition that clearly indicates they were used for purposes other than those strictly necessary for the Customer to verify the Product's nature and characteristics. In the event of a rejected return, Pop Corn Milano will notify the Customer and will not proceed with the refund of the price paid, reserving the right to seek compensation for any damage attributable to the Customer's conduct.
The refund of the price of returned Products will be processed by Pop Corn Milano without undue delay and, in any case, within 14 (fourteen) days from the date Pop Corn Milano became aware of the Customer's exercise of the right of withdrawal. Pop Corn Milano reserves the right to withhold the refund until it has received and verified the Product. The refund will be made using the same payment method used by the Customer for the purchase. Pop Corn Milano will confirm the refund via email.
The return of Products under this article is only permitted for purchases made on the Website.
Given that Customized Products are permanently modified and personalized specifically for the Customer and that their original production cannot be restored in any way, the right of withdrawal cannot be exercised for Customized Products. However, the exclusion of Customized Products from the right of withdrawal does not prejudice the application of legal warranties to such products.
