General Information


1.1. The sale of products (“Products”) offered on our website www.christianvilla.it (the “Website”), under the brand names “POP CORN MILANO SRL” and “Christian Villa” (the “Brands”) is regulated by these General Conditions of Sale (the “Terms and Conditions”)


1.2 POP CORN MILANO SRL. ("POP CORN MILANO SRL") reserves the right to apply specific contractual estimates (the “specific estimates”) to any order (hereinafter “Order” or “Orders”). In this case, the contractual conditions applicable to an order will be both the TERMS and the specific estimates intended as independent and separate contractor.


1.3 The products are directly sold by Christian Villa, a commercial brand of the POP CORN MILANO SRL company.


1.4 POP CORN MILANO is a company under Italian law headquartered in SS 11 Padana Superiore, 16 ° 20063 in Cernusco sul Naviglio, Milan, Italy. V.A.T.:IT 09270250153.


2. Commercial policy


2.1. Products are exclusively intended for sale to individuals who are final consumers (“customers”). Customers are individuals acting for purposes not related to trade, business or professional activity.


2.2 Christian Villa reserves the right not to accept orders from those who are not “Customers”.


2.3 At any time Christian Villa may modify these Terms. The Customer will be subject to the terms in force at the time the order is submitted.


2.4 Orders may be for one or more products, notwithstanding Christian Villa’s right to establish a maximum quantity that the customer can order in any order.


2.5 The maximum quantity of products that can be purchased by the customer in any order is 5 units (5 pairs of shoes). In addition to these maximum quantity, Christian Villa reserves the right to limit the quantity of the product ordered as he wants from time to time.


2.6 No product will be ship for delivery or distributed to an address containing a p.o. box or if Christian Villa is unable to identify the individual receiving the order or his/her private address.


2.7 All communications to be sent by email under the terms will be sent to the email address provided by the customer on the website.




3. Terms of purchase


3.1 Each products offered for sale may be selected through a dedicated web page where it will be possible to view the photo of the product, the unit price and the available size (if applicable).


3.2 Some products may be displayed on the website only for promotional reasons and not for sale. Those products are not for sale and cannot be purchased.


3.3 In some cases the photos and colours of the products offered may differ from those viewed on the website and this is due to the technical characteristics and resolution of the equipments and softwares used by the customer.


3.4 After selecting the desired products, the costumer will have to follow the instructions and procedures provided on the website to place any order. 


3.5 The Customer is responsible for verifying the accuracy of the content of each order before the order is confirmed, in addition the customer is responsible for filling out the purchase form in accordance with the instructions provided on the respective page of the website. By completing each order, the customer confirms that he/she has carefully read and accept the Specific Terms and Estimates.


3.6 Whenever the customer wishes to make changes or corrections to the order after the confirmation, the customer must contact the Costumer Service  (“Costumer Service”) at the email address displayed on our Website in the “Contact Us” section. A confirmed order cannot be modified or cancelled, except as expressly provided by the Terms, by the Specific Estimates or otherwise provided by applicable law. The customer can verify the status of an order at any time by contacting customer service at miriam@popcornmilano.com


3.7 As soon as the customer place an order, it is recommended to download and save or print the Terms provided at the time of placing the order and any Specific Estimates applicable to the order. The Customer will also receive a confirmation email (“Email”) of an order received containing a summary of the information already contained in the order form (e.g. Customer data, shipping method and address, information regarding each product purchased, price and delivery rate information (“data”).



 4. Availability and delivery


4.1 The Customer acknowledges that the stock of the products offered on the website are limited.


4.2 Occasionally, some products may not be available. In this case, Christian Villa will inform the Customer as soon as possible and, in any case, within forty-eight (48) hours (excluding weekends and holidays) from the date of receipt of the order by Christian Villa. If a product ordered is not available, the order will be fulfilled once it becomes available again.


4.3 The Customer acknowledges that when an order is shipped to the internal unit of Villa Cristiana, responsible for the fulfilment of such order, an email will be sent to the customer.


Sometimes this email will be replaced by the shipping advise. Christian Villa will send an email to the customer when package containing the ordered Products leaves the warehouse. However, delivery times are not guaranteed and are estimates only.


4.4 Christian Villa will do everything possible to satisfy each Order within ten (10) working days and, in any case, within twenty (20) working days from the day after the customer places the order, but he does not guarantee to do so. However, Christian Villa will not be responsible and will not compensate the Customer for any claim, loss or expense resulting from the failed shipment by Christian Villa of an order within the established terms.


4.5 The Customer can contact Customer Service for assistance with any problems regarding the delivery.



 5. Prices and payment


5.1 The prices of the products offered on our Website include the sales tax applicable at the time of payment.


5.2 Prices are expressed in Euros (€).


5.3 Each order from the European Union and the United Kingdom is exempt from shipping costs. Shipping costs to countries of the European Union and the United Kingdom will be borne by Christian Villa.


For orders placed outside the European Union and the United Kingdom (United Kingdom), the shipping cost will be displayed during the check out, while any customs duties or taxes that may be applied by the importing countries will be charged to the customer.


5.4 Christian Villa reserves the right to modify the prices of the Products offered at any time and without notice. The prices published on our Website at the time of confirmation of an oder are the prices that will be applied to that order.


5.5 The payment can be made by credit card, debit card and PayPal.


Accepted cards: Visa Mastercard, American Express, Discover, JCB, Diner's, Maestro. Credit card transactions will be will be governed by the specific rules of the credit card provider.


5.6 Each order will be completed only after the verification of the customer’s credit card data.



6. Orders


6.1 The Customer will have to check the products immediately after the delivery to verify the compliance with the Order.


6.2 The Customer will have to describe any defects (e.g packaging shows signs of tampering, damaged products, missing products or items, Products different from those ordered and/or indicated in the shipping document) by writing them on the delivery document that must be signed by the customer.


6.3 If one or more delivered products are different from those ordered or are damaged, the Customer must inform Christian Villa immediately by contacting Customer Service, unless such defects are described in the delivery document as provided in paragraph 6.2. In this case the Customer can:


(i)    Return the Product and request a replacement Product


(ii)   Accept the defective product, or


(iii)  If a replacement Product is not available, return the whole or part of the order. The Customer has no right to any other compensation or options, subject to the mandatory provisions of the applicable law.


6.4 In case of returns, the Customer must carefully follow the return process set by Christian Villa. Christian Villa suggests that customers contact the customer service for any information and to return any products. The Customer is free to choose any other courier service at the Customer’s expense.



 7. Returns


7.1 The Customer has the right to return product(s), with no penalty and with no obligation to specify the reason, by returning received products to Christian Villa within fourteen (14) days from the date on which these products were delivered.


7.2 The Customer can return part or the whole order, without prejudice to paragraph 7.1


7.3 The Customer acknowledges that:


•    The Customer is responsible and assumes any risks related to the shipment, including delays;


•    Postage costs to return products, defective products, any regulations or import duties imposed on products returned in Italy will be borne by the Customer.


7.5  Customers can choose to use any courier service for returns at the expense of the Customer.


7.6 In addition to the provisions of paragraphs 7.1 and 7.3, in order to be a valid and effective return, the products must be returned in their original condition and original packaging;


Christian Villa will check that all the returned Products are still in their original conditions.


7.7 If the return procedure is in compliance with the above-mentioned conditions, Christian Villa will refund the customer with the amount already paid with credit card as soon as possible and, in any case, within fourteen (14) days from the moment Christian Villa receives and checks the returned products. The amounts will be refunded when credited in the original form of payment within and no later than the above mentioned term.


7.8 Christian Villa will only accept returns or replacement or refund requests exclusively for Products purchased on the website by following the procedures previously stated.



8. Product liability


8.1 Christian Villa makes no warranties or representations, express or implied, including, without limitation, an implied warranty of merchantability and fitness for a particular purpose, which are expressly excluded by the customer, with respect to any product. Christian Villa will not be liable to the Customer or any other users or next users for any damages, losses or complaints, direct, indirect or consequential, for injuries and property damages, in any matter and the customer relinquishes any complaints on his/her behalf and on behalf of any person or Party to whom he/she transfers the products.


8.2 In the event that a Product is not conforming to the order, the Customer’s remedies are those described in paragraph 6.3. Under no circumstances Christian Villa will be responsible for claims for direct, immediate, foreseeable, incidental, consequential or special damages, directly or for any expenses incurred as result of use or abuse, sale or manufacture of products  not complying with the terms and the Order Conditions.



9. Applicable Law and disputes



9.1 These Terms and any Specific Estimates are governed by Italian law.


9.2 If disputes relating to the Terms, to any Specific Estimates or to any orders arise, this dispute will be referred to arbitration in Italy.
